Over the past four years, the Advisory Committee on the Rules of Civil Procedure has been diligently working on proposed amendments designed to address the expanding cost of data preservation and the uncertainties associated with courts meting out sanctions for spoliation. This 90-minute panel will explore how the committee has proposed revising the rules, and the implications on preservation and litigation strategies going forward. Will the standards that define reasonableness and good faith effort change? What are best practices when it comes to responding to a duty to preserve, and how can litigants mitigate the anticipated costs of preservation?
