Legal Hold Pro™ Adds Collection Tracking Capability to Enhance Industry-Leading Legal Hold Management System
LegalTech™, New York, January 30, 2012 – Zapproved® Inc. announced today that Legal Hold Pro can now

issue preservation or collection requests and track results.
The new functionality supports defining any number of detailed tasks, with assigned resources such as IT personnel
or records managers being able to report progress on each task. Hold managers can monitor in real-time both custodian
compliance and collections progress, and retain a complete history of all actions taken.
Legal Hold Pro has become the fastest growing legal hold management system by helping corporate legal teams and law
firms implement defensible preservation efforts. The on-demand system is intuitive to operate and can be used immediately
without the need to install, configure or maintain software.

Zapproved Publishes "Pension Committee Revisited: One Year Later" to Commemorate
the Anniversary of Judge Scheindlin’s Landmark Opinion
Portland, Ore., January 18, 2011 – Zapproved Inc. announced today that it
has released a new report titled "Pension Committee Revisited: One Year Later,"
a 42-page retrospective on the impact of Judge Shira A. Scheindlin’s influential
opinion. Since the opinion was issued one year ago, Pension Committee of the University
of Montreal Pension Plan, et al. v. Banc of America Securities, LLC, et al.
has focused the legal community on issues surrounding the preservation of electronic
data involved with litigation.
"Pension Committee Revisited" is edited by Brad Harris, a nationally recognized
e-discovery expert and Vice President of Legal Products for Zapproved, and Ron Hedges,
a former United States Magistrate Judge. "Pension Committee Revisited"
is available to download immediately at no cost at
www.legalholdpro.com/pensioncommittee.
The comprehensive white paper includes a summary of the opinion, subsequent discourse,
and an analysis of eight additional opinions in 2010 following Judge Scheindlin’s
work. A highlight of this publication is the contributions by luminaries in the
field of electronic discovery featured in "Reflections on Pension Committee."
This section includes essays by Craig Ball, Kevin Brady, William Butterfield, Maura
Grossman, John Jablonski, Ralph Losey, Browning Marean, Jonathan Redgrave, Denise
Talbert and Paul Weiner.
"In the year since Judge Scheindlin issued the 89-page Pension Committee
opinion, it remains in the forefront of argument about data preservation, spoliation
and sanctions, and has framed the public discussion among jurists and practitioners,"
said Ron Hedges. "Our goal was to capture a snapshot of these conversations
and help inform ongoing dialogue that is shaping how law will be practiced for years
to come."
"We prepared this retrospective to assemble into a single volume a snapshot
of this impactful opinion," added Brad Harris. "Since we started this
project it has become even more evident what a catalyst this opinion has been in
driving awareness around preservation practices. We were honored to receive contributions
by a distinguished group that added their own perspectives on what they see as the
lasting impact of Pension Committee."
Complimentary printed copies of "Pension Committee Revisited" will be
available while supplies last at the 2011 LegalTech New York tradeshow from January
31 to February 2 at the Hilton New York. As a bonus, the white paper also includes

Zapproved Publishes "The Enlightened Legal Hold" by Brad Harris and Craig
Ball that Offers a Fresh Approach to Legal Holds Following the Pension Committee
Opinion
ILTA 2010, Las Vegas, August 24, 2010 – Zapproved Inc. announced today that
it has released a new report titled "The Enlightened Legal Hold: A New Approach
to Legal Preservation Following the Pension Committee Opinion" co- authored
by Brad Harris and Craig Ball. The latest white paper in the Legal Hold Pro™
Signature Series examines issues that have caused problems for litigants and offers
a new way to think about the legal hold process. "The Enlightened Legal Hold"
is available to download immediately at no cost at
www.legalholdpro.com/enlightened.
Since Judge Scheindlin’s Pension Committee opinion in January 2010, there
has been a steady drumbeat of opinions sanctioning litigants for failing to properly
implement legal holds. The problems appear to be systemic as organizations have
not adequately addressed the basic challenges of preserving electronically stored
information (ESI). As the authors point out, "Legal holds can be complicated,
but the reasons they fail are usually pretty simple."
In "The Enlightened Legal Hold," Harris and Ball start by examining the
"Five Deadly Sins of Legal Holds," which are the common underlying reasons
for the slow pace of change. They then turn to a new way of thinking embodied in
the seven "Principles for Legal Hold Enlightenment" that embrace the concept
that a legal hold is an organic process and offer practical steps that any legal
professional can follow to mitigate risk in legal preservation.
The authors are nationally recognized electronic discovery experts. Brad Harris,
Vice President of Legal Products for Zapproved, has assisted Fortune 1000 companies
to enhance their e-discovery preparedness and is a frequent presenter on the issue
of legal holds. Craig Ball is a Board Certified trial lawyer, certified computer
forensic examiner, electronic evidence expert, and award-winning columnist. He lectures
internationally on aspects of electronic discovery and has been involved in some
of the most challenging and well-known cases in the U.S.

Falcon Discovery Partners with Zapproved to Add Legal Hold Pro™ to Falcon’s
Groundbreaking InsideOut™ Managed Service for Corporate Legal Departments
Denver, CO August 19, 2010 — Zapproved and Falcon Discovery, a niche

a new partnership combining Falcon Discovery’s groundbreaking InsideOut™
managed service with Legal Hold Pro, the industry’s first pure Software-as-a-Service

Falcon’s decision to add Legal Hold Pro as a key element to InsideOut™
extends the range of technologies that Falcon employs to create a repeatable, defensible
and efficient in-house process for managing legal holds and compliance. This area
of preservation has come under increasing scrutiny in 2010 as Federal and state
court decisions now underscore the importance of tightly managing legal holds and
compliance during preservation. The Falcon Discovery and Zapproved partnership provides
clients with a solution that targets the heightened risks around preservation, and
also significantly streamlines the in-house e-discovery process.
"This alliance dovetails with Falcon’s mission to reduce our client’s
e-discovery risks and costs, by delivering the type of best-in-class technology
and process re-engineering that is at the core of our InsideOut™ model,"

as an industry leading firm that is taking a unique approach to helping their clients
better manage e-discovery in-house," said Monica Enand, President and CEO of
Zapproved. "Legal Hold Pro completes the suite of technologies by being a ready-to-deploy
solution for helping issue, track and ensure compliance with a defensible legal
hold."
Legal Hold Pro lowers cost and reduces risk in litigation by tracking every action
in detail while enabling best practices by making issuing and refreshing legal holds
a simple process. When compared with labor-intensive manual processes, the system
reduces errors and the time needed to manage and track compliance activities. Since
Legal Hold Pro is fully web-hosted, there is no need to install, configure or maintain
the software.
Falcon Discovery is transforming the way corporate legal departments and law firms
manage discovery in the digital age. Falcon’s InsideOut™ managed service
can often respond to internal investigations or urgent discovery requests in a matter
of hours—not days or weeks—and at a fraction of the cost of traditional outsourcing.

repeatable in-house processes, legal acumen and expertise managing advanced technology
make every step more efficient and cost-effective. Falcon’s InsideOut™

Zapproved Expands the E-Discovery Preservation Workflow in Legal Hold Pro with New
Custodian Interview Feature
New York, February 1, 2010 — Zapproved Inc., a Software-as-a-Service
(SaaS) provider with a platform that adds accountability to business communications,
announced today at LegalTech the release of a new capability for creating, managing
and recording custodian interviews as part of its Legal Hold Pro tool. Legal Hold
Pro is the first pure cloud-based system for managing legal hold notifications in
compliance with legal best practices.
Legal Hold Pro’s automated legal hold management process ensures a precise and complete
compliance audit trail and a highly efficient preservation workflow. The new custodian
interview feature is available now and enables legal teams to both validate their
preservation efforts and ready their collection efforts by recording interview responses.
Such interviews can then serve as a foundation for gathering responsive electronically
stored information (“ESI”) and documents.
By managing the custodian interview process in Legal Hold Pro, users will lower
their litigation risk, improve efficiency and enhance defensibility through a predictable
and repeatable litigation hold process. When initiating a litigation hold, counsel
and litigation support teams create an online questionnaire for custodians to complete
as part of the response process. The survey can be configured with either multiple
choice or open-ended questions. All custodial responses are automatically tracked
and added to the audit trail of the preservation notice.
“By extending Legal Hold Pro to include management of the custodian interview, counsel
can now more efficiently solicit and record critical information early on from custodians,”
said Brad Harris, Director of Legal Products for Zapproved. “This feature was developed
in concert with our user community and shows the advantages of a SaaS tool because
we can rapidly roll out new features in weeks based on direct customer feedback.”
The Legal Hold Pro service is available on a monthly subscription basis starting
as low as $150 per month. There is no long-term commitment required to start using
the system, since data can be exported at any time. Zapproved is also making the
service available to organizations for unlimited use with annual subscription pricing.
To see a demonstration of Legal Hold Pro at LegalTech in New York February 1-3,

Portland Office of the City Attorney Selects Legal Hold Pro to Manage High Volume
of Litigation Holds Across Multiple Bureaus
Portland, Ore. February 1, 2010 — Zapproved Inc., a Software-as-a-Service
(SaaS) provider with a platform that adds accountability to business communications,
announced today that the Office of the City Attorney in Portland has chosen Legal
Hold Pro to manage litigation hold notification and compliance tracking for the
City Government. As a SaaS-based tool, the City Attorney’s Office is able to rapidly
roll out Legal Hold Pro because no software installation or configuration is necessary.
The Office of the City Attorney has a staff of more than 50, including 34 attorneys
and more than 21 paralegals and legal assistants. The City Attorney’s Office handles
all litigation that involves the city and its bureaus. This broad scope of responsibility
leads to a high number of legal holds being issued regularly and requires a thorough
system for management and compliance. The Legal Hold Pro system will be used jointly
by the staff of the City Attorney’s Office and Portland’s Risk Management Division
to improve compliance and tracking of litigation preservation notices.
“Our office handles cases for the entire city government so we frequently need to
issue holds across multiple departments and bureaus,” said Linda Meng, Portland’s
City Attorney. “We anticipate that Legal Hold Pro will help us to better manage
our high volume of legal holds while reducing our expenses through improved efficiency.
We believe it will enable our attorneys, risk managers and records managers to collaborate
and ultimately lower our risk.”
A legal hold, or litigation preservation hold, is an action taken by an organization
to prevent alteration or destruction of data and documents that may be relevant
to a lawsuit or governmental investigation. Failure to properly implement a legal
hold by sending timely notifications to custodians of information and tracking their
acknowledgment and compliance can jeopardize a case and lead to sanctions by the
courts.
“Having an opportunity to collaborate with the Portland City Attorney’s Office allows
us to show the efficacy of Legal Hold Pro in a public agency,” said Monica Enand,
President and CEO of Zapproved. “We see the public sector at all levels as natural
customers for our SaaS-based system due to productivity enhancements and ease of
implementation.”
Legal Hold Pro is the first pure cloud-based system for managing custodian notification
and compliance for legal holds. The system’s automated process ensures a precise
and complete compliance audit trail and a highly efficient preservation workflow.
Legal Hold Pro reduces risk in litigation by tracking every action in detail while
enabling best practices by making issuing and refreshing legal holds a simple process.
When compared with labor-intensive manual processes, the system reduces errors and
the actions needed to manage and track compliance activities.

Zapproved Publishes In-Depth Analysis of Judge Scheindlin’s “Pension Committee”
Opinion and Its Impact on Legal Hold Processes
Click here to view PDF of this release.
Portland, Ore. January 29, 2010 — Zapproved Inc., a Software-as-a-Service
(SaaS) provider with a platform that adds accountability to business communications,
announced today that it has released “The Pension Committee Opinion: Judge Scheindlin’s
Call to Action for Effective Legal Holds.” The in-depth analysis was authored by
Brad Harris, Director of Legal Products for Zapproved, and legal hold expert, John
Jablonski, Partner at Goldberg Segalla LLP. The analysis interprets the opinion
and its practical effect on the duty to preserve evidence in the United States and
the contemporary standard for litigation hold processes developed by courts over
the last few years. The 14-page paper, part of the Legal Hold Pro™ Signature Series,
is available immediately at no cost at
www.legalholdpro.com/scheindlin.
On January 11, 2010, Judge Shira Scheindlin issued an opinion in The Pension Committee
v. Banc of America Securities case that strongly affirms the need for organizations
to issue written litigation hold notices as part of a robust litigation hold processes.
Following Judge Scheindlin’s seminal Zubulake opinions in 2004, this blockbuster
89-page opinion revisits many of the issues around legal preservation. The opinion
concentrates on the weaknesses of the legal hold efforts of the plaintiffs in the
$550 million securities litigation. Among the key rulings by Judge Scheindlin is
that “the failure to issue a written hold constitutes gross negligence because that
failure is likely to result in the destruction of relevant information.” (p.36)
“This is clearly a landmark opinion and since it was issued I have been receiving
a lot of calls seeking an interpretation of the opinion,” said Jablonski, co-author
of 7 Steps for Legal Holds of ESI and Other Documents (ARMA, 2009). “We worked extremely
hard over the last two weeks to conduct a thorough analysis which we believe will
serve as a guidepost to help corporations and others understand the real world implications
of The Pension Committee opinion. The report includes a checklist of legal hold
duties created or discussed by the opinion and recent cases that corporations and
their lawyers can review to help meet the litigation hold expectations of the modern
court.”
“John and I wanted to go beyond a play-by-play of Judge Scheindlin’s opinion and
illustrate how this case will impact in-house legal teams and outside counsel,”
said Harris. “Judge Scheindlin effectively redefined the ‘contemporary standard’
of litigation holds so we felt it was imperative to communicate that to the legal
community immediately.”
At the upcoming LegalTech show in New York at the Hilton New York from February
1-3, 2010, complimentary printed copies of the report will be available while supplies
last in Booth #320 where Zapproved will be demonstrating its Legal Hold Pro product.
John Jablonski will present on Monday, February 1, at 4 p.m. at LegalTech and will
discuss The Pension Committee opinion in the course of that session about legal
holds.
For further comment on the decision or the state of legal hold requirements in the
United States, contact attorney John Jablonski at (716) 566-5469 or send an email

Zapproved Publishes “12 Myths about Legal Holds,”
A Complimentary White Paper to Help Organizations Mitigate Risk from Poor Litigation
Hold Management

Portland, Ore. January 11, 2010 — Zapproved Inc., a Software-as-a-Service
(SaaS) provider with a platform that adds accountability to business communications,
announced today that it has released a new white paper titled “12 Myths about Legal
Holds” authored by Brad Harris, the company’s new Director of Legal Products. The
first paper in the Legal Hold Pro™ Signature Series is available immediately at
no cost at www.legalholdpro.com/myths.
The 12-page publication zeroes in on common misconceptions about litigation holds
that are frequently encountered within organizations that are failing to implement
reasonable and good faith efforts when it comes to executing legal holds for discovery.
Mr. Harris uses recent case law, particularly experience throughout 2009 during
a watershed year for legal hold findings, to illuminate current best practices for
legal hold notification and compliance procedures. Some of the myths that he addresses
include the idea that requesting acknowledgments from custodians somehow adds risk,
that legal holds are for defendants only, and that “collecting everything” eliminates
the need to issue a legal hold notice.
Mr. Harris is an e-discovery expert who has focused on the area of legal hold notification
and compliance for the last five years, advising organizations and presenting regularly
on the topic. He is a frequent author and speaker on e-discovery issues, including
articles in Corporate Counsel, Metropolitan Corporate Counsel and KMWorld and presentations
at leading industry events such as Legal Tech New York.
“When consulting with organizations about legal holds and speaking to legal professionals,
I have frequently encountered misconceptions about how to implement litigation holds,”
Mr. Harris said. “As 2009 illustrated, the courts are no longer tolerating poor
execution and are issuing sanctions to those who do not have robust legal hold practices
in place. With 12 Myths I am taking aim at misguided notions about legal holds to
guide organizations in the right way to do them.”
Mr. Harris will be hosting a webinar about “12 Myths about Legal Holds” that will
explore the subject in more depth. The complimentary webinar will be held at 2 p.m.
EST, Tuesday, January 26, 2010.
